Domestic Violence

DOMESTIC VIOLENCE TEMPORARY RESTRAINING ORDER

Temporary Restraining Order (“TRO”) was entered against client alleging that he put a gun to the victim’s head and threatened to kill her, terroristic threats, assault and other predicate acts of domestic violence. Following a full trial with multiple witnesses, the judge dismissed the TRO against the client, finding that the victim was not credible.


DOMESTIC VIOLENCE TEMPORARY RESTRAINING ORDER

Temporary Restraining Order (“TRO”) was entered against client alleging rape and other predicate acts of domestic violence. Mr. Lee filed a number of pre-hearing motions, including motions seeking psychological/psychiatric records pertaining to the victim. After extensive motion hearings, the TRO was dismissed by the judge.

Misdemeanors

JURY TRIAL ON STALKING CHARGES

Client was charged with stalking and other related charges arising out of a restraining order. There were several attempts to effectuate a favorable plea, Mr. Lee had no choice but to go forward to trial. At the conclusion of trial, the jury returned a verdict of “not guilty” and the client was cleared of all charges.

Theft Crimes

SECOND DEGREE THEFT BY DECEPTION CHARGES

Client was charged with 2nd degree theft by deception alleging a fraudulent scheme that went on for years. Client admitted to charges. Pursuant to the plea, the State’s sentencing recommendation was for county jail time as a condition to probation. At sentencing, Mr. Lee was able to successfully argue a number of mitigating factors to avoid any additional jail time for his client. Court sentenced the client to probation, no jail.

White Collar Crimes

CREDIT CARD FRAUD

Client was charged with credit card fraud, alleging that the client defrauded a business partner. The indictable charges were downgraded and the case was heard in municipal court. Mr. Lee made a pre-trial motion to dismiss the charges arguing that the State could not sustain its burden of proof at trial as a matter of law. The motion was granted by the court and the case was dismissed.
